Witness-Centered Deposition Preparation:
Defeating the Reptile and Regaining the Edge
The Cognitive Litigator, LLC
At Reverse the Reptile, Robin Jackson-Bernhardt bridges law and psychology. A seasoned trial attorney and trained mental health therapist with a forensics background, she draws on 15+ years of expertise in cognitive processes to enhance witness prep. Using techniques like cognitive reframing, emotional regulation, and bias awareness, and grounding exercises, Robin delivers a balanced, strategic approach to litigation.
An Enhancement to The Litigation-Centered Approach
Most lawyers rely on a litigation-centered approach that focuses only on legal issues. Robin goes further, combining legal strategy with psychological insights in what she calls the “science of the witness”—an in-depth understanding of each witness’s background, learning style, and individuality. This unique witness-centered prep approach ensures a tailored, effective strategy for every deposition and trial.
Neutralizing Reptile or Edge Attacks in Trial
Reptile and Edge strategies build throughout litigation, peaking at trial. Preparing a witness for trial requires going over direct examination and strategies to deal with harmful deposition results and preparing them for cross examination. Our approach covers direct and cross-examination strategies, helping witnesses present as credible, composed, and well-prepared witnesses to the jury.
What Clients
Are Saying
“Robin has been an absolutely phenomenal help with my cases. I have brought her in a number of times to prepare my corporate representatives for deposition. Without fail, they have handled themselves well under pressure and told me they felt prepared and less anxious thanks to their sessions with Robin. More recently, I brought her in with a client who is very frustrated with the litigation process and was struggling to express his thoughts about the case well because of his frustrations. Robin’s sessions with him were instrumental in helping him manage his emotions. He kept his cool throughout his deposition, which made him much better able to express himself and his understanding of the accident. I am so grateful to have Robin on our team. Her education, experience, patience, and expertise are a perfect fit for reverse the reptile preparation.”
Trial Attorney
“Robin reptile-prepped my insured (general contractor) in a premise liability/construction catastrophic injury case – $8M demand. He appeared individually and as the corporate rep yesterday. He endured 7 1⁄2 hours of questioning like a BOSS. Thanks to Robin’s preparation!”
Attorney
“Deposition went surprisingly well! He didn’t talk too much, and he forced OC to be very specific and technical with his questions. Everything he said in the depo aligned with what he said during the preps, so no surprises. Depo lasted 4 hours. Thank you so much for all your help prepping him! I know it wasn’t easy, but he retained what you said and he did a good job!”
Attorney
“I was able to get Robin to prep my former DON extensively in one of my nursing home cases. I just had the depo and she blew it out of the water! Didn’t give a single inch after 5 hours of OC getting flustered. It was amazing! I can’t thank Robin enough because she really got her ready to be cool, collected, and to know what to look out for as far as reptile. Amazing result!”
Attorney
“I’m writing this to convey my gratitude for the amazing effort your firm does to prepare us for a deposition. I have to be honest, this is the first time I see a real effort from an attorney’s firm to prepare us. Robin has spent many hours working with my driver to get him ready and she’s incredibly knowledgeable and patient. The interpreting service, I must say, is also incredibly helpful and they make such an effort to help. I am very glad Robin will be working with me as well when I must give my deposition; it will make a huge difference. Thank you again for all you do.”
